Terms of Service

1. Agreement
By accessing or using the ChurchVine platform at churchvine.church ("Platform"), you agree to these Terms of Service on behalf of yourself and the organization you represent ("Church" or "Tenant"). If you do not agree, do not use the Platform.
ChurchVine LLC ("ChurchVine", "we", "us") reserves the right to update these terms at any time. Continued use after changes constitutes acceptance.
2. Platform Services
ChurchVine provides church management software including people and family directory management, attendance tracking, child check-in, communications (email and SMS), giving management, and related tools. Services are provided on a subscription basis.
3. SMS and Communications
The Platform enables churches to send SMS and email messages to their congregation members. By using the communications features, you agree to:
- Only send messages to individuals who have provided their contact information to your church and have a reasonable expectation of receiving such communications.
- Include opt-out instructions (e.g., "Reply STOP to unsubscribe") in all SMS messages.
- Comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and carrier guidelines.
- Not send unsolicited, spam, or harassing messages.
ChurchVine is the technology provider; your church is responsible for the content of messages sent and ensuring proper consent from recipients. Mobile opt-in information is not shared with third parties for marketing or promotional purposes.
4. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate information when registering and keep it up to date.
- You must be at least 18 years old to create an account.
5. Data and Privacy
Member data entered into the Platform belongs to the church. ChurchVine processes it as a service provider under our Privacy Policy. We do not sell, rent, or share member data with third parties for marketing purposes.
Churches are responsible for obtaining appropriate consent from members for data collection and communication, and for complying with applicable data protection laws.
6. Payments and Subscriptions
Subscription fees are billed in advance on a monthly or annual basis. Messaging credits (SMS and email beyond the free tier) are purchased as prepaid packs. All fees are non-refundable except as required by law or as stated in our refund policy. We reserve the right to change pricing with 30 days notice.
7. Acceptable Use
You agree not to use the Platform to:
- Send spam, unsolicited messages, or harassing content
- Violate any applicable law or regulation
- Infringe intellectual property rights
- Attempt to gain unauthorized access to systems
- Interfere with other users or the Platform's operation
ChurchVine may suspend or terminate accounts that violate these terms.
8. Intellectual Property
The ChurchVine platform, including its software, design, and content, is owned by ChurchVine LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform without our written consent.
9. Disclaimer of Warranties
The Platform is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free service. We are not responsible for losses resulting from Platform downtime or data loss.
10. Limitation of Liability
ChurchVine's total liability for any claim arising from use of the Platform shall not exceed the amount paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
11. Termination
Either party may terminate the subscription at any time. Upon termination, your access to the Platform will cease and data may be deleted after a 30-day grace period. You may request a data export before termination.
12. Governing Law
These terms are governed by the laws of the United States. Disputes will be resolved through binding arbitration, except where prohibited by law.
